By accepting these Terms and Conditions, you agree that your use of the Ctrl Visa Website/Portal including Software / Application / System related and linked to the Ctrl Visa, all applications, software and services available on the Website (except to the extent such services are subject to a separate agreement) will be governed by these Terms and Conditions as posted on the Website/s with any changes and modifications as may be made from time to time.
2. Eligibility of usage of Ctrl Visa Services
Ctrl Visa Services are available only to individuals / proprietors / organizations / corporates who can enter into a legally binding agreement(s) under the applicable law. Please do not use this website if you are not eligible, or are barred from entering into legally binding contracts or you are under the age of 18 or are temporarily or indefinitely restricted, suspended or prohibited from or accessing or using this or the linked websites, as may be applicable.

Ctrl Visa is an intelligent Web based technology application for Visa Processing which enables Customer / users / you to manage their visa operations efficiently (collectively referred to as “Ctrl Visa Services”). This technology is provided by Ctrl Visa on SAAS basis by giving timebound subscription to the users on payment of Ctrl Visa fee. When you are applying for a visa through Ctrl Visa portal for yourself/on behalf of your client / employees, Ctrl Visa makes the whole application process digitised, helps increase productivity, optimise resources, reduce errors, helps scale up visa business. Descriptions of the Ctrl Visa Features and applicable fees under various plans are available on our website.
Any additional or new services provided by Ctrl Visa are subject to these Terms and Conditions.

4. How Ctrl Visa handles your documents and personal information while availing Ctrl Visa Services? How is your data processed?
When you decide to avail Ctrl Visa Services and subscribe to the Ctrl Visa Services, and you give your consent for us to process your data/documents, you will be prompted to upload your documents and personal information directly into the Ctrl Visa portal for completing your visa application form or your client’s / employee visa application on his / her behalf. In case you process your client’s/ employee visas through Ctrl Visa portal, you are required to take their consent to process their data / documents.
Documents and personal information of yours / your client’s/ employee are yours / theirs. These Terms and Conditions don’t give us any rights except for the limited rights that enable us to offer the Ctrl Visa Services. We let customers know the information we have on them and allow them to opt out of specific services or wants to purge any of the their data belonging to them with Ctrl Visa. Ctrl Visa Services also provides you with features like document upload, previews, download, easy sorting and organisation, and personalisation to help reduce your workload. To provide these and other features, Ctrl Visa receives, accesses, stores, and scans your documentation. For those services, you give us permission to do just those things, and this permission extends to our affiliates and trusted third parties we work with.
Your rights with respect to information we hold about you as a controller:
If you are in the European Economic Area (EEA), you have the following rights with respect to information that Ctrl Visa holds about you. Ctrl Visa undertakes to provide you the same rights no matter where you choose to live.

We will also securely store the information and isolate it from further processing on backup discs until deletion is possible.
5. Applying for a visa using Ctrl Visa Services
Ctrl Visa will only provide visa processing technology that you have requested for. Ctrl Visa endeavours to provide you with accurate visa requirements / forms in the Ctrl Visa portal. Please keep in mind that all visa application requirements are based on specific country criteria and are subject to change without prior notice and may require additional information from you. Ctrl Visa will inform you about the changes as soon as practicable, upon receiving information of the same.
Processing Times
Ctrl Visa will not be responsible for processing time taken by you / your staffs / Diplomatic Mission.
Visa approval
Ctrl Visa is only technology Provider. Ctrl Visa cannot guarantee any visa approval or timeline. The Diplomatic Embassy of the visa issuing country has the final word on allowing entry into the pertinent country or region even if all requirements have been fulfilled.
It must be noted that the grant or refusal of a visa is at the sole discretion of the Diplomatic Embassy of the country or countries you are applying for a visa and Ctrl Visa is not involved in the decision making process nor is Ctrl Visa liable or responsible in any manner whatsoever for any delay in processing or granting or rejection of the visa application of any visa applicant by the Diplomatic Embassy of the country or countries for which you are applying for a visa. The Diplomatic Embassy of the country or countries you are applying for a visa reserves the right to ask for further documentation and/or to refuse the visa application.
The procedures, documentation requirements and fees relating to any visa application are outside the control of Ctrl Visa and are subject to change without prior notice. Ctrl Visa does not accept responsibility for any changes in procedures.
Ctrl Visa will inform about changes in procedures, documentation requirements and incorporate in the Ctrl Visa portal relating to any visa as soon as practicable, upon receiving information of the same.
Ctrl Visa Fees
Ctrl Visa fees are those specified on Ctrl Visa website and shall exclude government-imposed taxes, where applicable. Ctrl Visa fees include Subscription fee and per transaction fee as specified on Ctrl Visa website. Ctrl Visa fees is subject to change with prior intimation to you. To use Ctrl Visa, it is imperative that user has made all payment of Ctrl Visa Fees in advance as applicable to users as per the payment terms to avail Ctrl Visa Services.
General payment terms: Yearly Subscription fee will be paid by user in advance upon subscribing the Ctrl Visa portal and will be paid yearly in advance on renewal.
Per visa transaction cost / minimum monthly guarantee and any other cost related to subscription will be paid by the user by 1st day of the month to which the charges are related.
Cancellations and Refunds policy of Ctrl Visa
Ctrl Visa fees collected from you for using Ctrl Visa portal are non-refundable.
6. Your Responsibilities
Ctrl Visa is only technology provider. You need to verify all the data collected from your customers through Ctrl Visa portal..
Although Ctrl Visa always maintains the highest security standards when handling your information, we request that you keep your documents and information protected by safeguarding your password. Please, do not share your account credentials or give others access to your account.
You may use Ctrl Visa services only as permitted by applicable law.
7. Use of Ctrl Visa websites/Portal
While accessing or using Ctrl Visa website, the user shall not:
i. Post any content or items in an inappropriate category or areas on the Website nor post any material in whatever form, on the Website for any purpose other than the purpose for which the website is intended;
ii. Violate any laws, third party rights, or policies of Ctrl Visa ;
iii. Interfere with the technological operations of the Website or attempt to manipulate the content or material on the Website or of any other user or users;
iv. Post false, inaccurate, misleading, defamatory, or libellous content including personal information;
v. Use any robot, spider, search engine, scraper or other means whether manual, automated, mechanical, electrical or electronics either existing or that may be invented or discovered to access the Website and/or to do any of the acts mentioned above for any purpose other than the normal purpose for which the website is intended;
vi. Take any action that imposes or may impose (in our sole discretion) an unreasonable or disproportionately large load on Ctrl Visa infrastructure; interfere or attempt to interfere with the proper working of the Website or any activities conducted on the Website;

x. Send, post, plant or distribute viruses or any other technologies that may harm Ctrl Visa , or the interests or property of users; Copy, modify, or distribute content from the website and/or Ctrl Visa ’ copyrights and trademarks or other intellectual property; harvest or otherwise collect information about other users, their details, or any information relating to any other user's passport details, email addresses, etc. In the case of any unlawful, illegal or prohibited use, the user shall be liable for action under applicable laws including any claim for damages. Ctrl Visa does not assume responsibility for the loss, damage, delay or destruction of documents by third parties such as a delivery service or Diplomatic Missions (unless required by applicable laws).
Ctrl Visa or any of its officers, directors, employees or agents shall have no responsibility and/or liability of any nature, for any reason whatsoever for any delays, or for loss of or damage to any visa application, passport or other documents, caused by, or occurring whilst any application, passport or document is in the possession of, any third party postal or delivery service, including, during the process of transportation of visa applications, passport or other documents between you / your client / employees and the Diplomatic Embassy and when being returned by you to your client / employees.
10. No Warranty & Limitation of Liability
THE WEBSITE AND THE CONTENTS AND SERVICES AVAILABLE ON THE WEBSITE ARE MADE AVAILABLE STRICTLY ON AN 'AS IS' AND 'AS AVAILABLE' BASIS. CTRL VISA MAKES NO REPRESENTATIONS OR WARRANTY ABOUT THE COMPLETENESS, ACCURACY, RELIABILITY, SUITABILITY OR AVAILABILITY WITH RESPECT TO THE WEBSITE OR ITS CONTENTS OR SERVICES PROVIDED THROUGH IT OR THE RESULTS TO BE OBTAINED FROM USING THE WEBSITE, OR THE CONTENTS OR SERVICES MADE AVAILABLE AT THE WEBSITE.WHERE YOU RELY ON ANY INFORMATION OR OTHER MATERIAL CONTAINED IN IT, YOU DO SO ENTIRELY AT YOUR OWN RISK AND YOU ACCEPT THAT ALL WARRANTIES, CONDITIONS AND UNDERTAKINGS, EXPRESS OR IMPLIED, WHETHER UNDER APPLICABLE LAW, TRADE USAGE, COURSE OF DEALINGS OR OTHERWISE IN RESPECT OF THE WEBSITE ARE EXCLUDED TO THE FULLEST EXTENT PERMITTED BY LAW.

The user agrees to indemnify and hold Ctrl Visa , its officers, directors, agents, subsidiaries, joint venture partners and employees, harmless from any claim or demand, including reasonable attorney’s fees, made by any third party due to or arising out of the breach of these Terms and Conditions, or violation by the user of any law of any country or the rights of a third party.
12. Injunctive Relief
The user acknowledges that a violation or any attempt thereof for any of the Terms and Conditions shall cause irreparable damage to Ctrl Visa , the exact amount of which would be difficult to ascertain and for which there will be no adequate remedy at law. The user agrees that Ctrl Visa shall be entitled to obtain injunctive relief issued by any court of competent jurisdiction, restraining the violation or any attempt thereof of the terms and conditions by user, or its affiliates, partners, or agents. Ctrl Visa shall be entitled to recover from the user all costs and expenses incurred by Ctrl Visa in obtaining the injunction, including attorney's fees.
13. Ctrl Visa trademark, registered products and Intellectual Property rights.
Ctrl Visa Services are protected by copyright, trademark laws of India and other foreign laws. These Terms and Conditions don’t grant you any right, title, or interest in the Ctrl Visa Services, others’ content in the Services, Ctrl Visa trademarks, Copyright logos and other brand features.
Whiteboard Idea Labs Private Limited owns or is licensed to use all intellectual property rights associated with the Website / portal and its contents including logos, graphics, icons ("Intellectual Property"). The Intellectual Properties are protected under the applicable laws and may not be copied or imitated or used or reproduced, in whole or in part. Ctrl Visa grants you a limited, personal, non-transferable and revocable license to access and use the Website / portal and the services only in the manner permitted by Ctrl Visa. Apart from such limited license no other right or interest is granted by Ctrl Visa in the Website or its contents or services which shall always remain the property of Ctrl Visa , its affiliates or third parties.
14. Termination of Ctrl Visa services.
You can stop using Ctrl Visa Services at any time.
We reserve the right to suspend or terminate your access to the Services without notice to you if:
(a) you are in breach of these Terms and Conditions,
(b) your use of the Ctrl Visa Services would cause a real risk of harm or loss to us or other users
Ctrl Visa will provide you with reasonable advance notice via the email address associated with your account to remedy the activity that prompted us to contact you and give you the opportunity to seek remedy of the situation. If after such notice you fail to take the steps, we ask of you, we’ll terminate or suspend your access to the Services.
We shall not provide notice before termination where:
(a) you are in material breach of these Terms and Conditions,
(b) any payment outstanding to Ctrl Visa for more than 15 days
(c) doing so would cause us legal liability or compromise our ability to provide the Services to our other users, or
(c) it is mandated by any applicable law.
We may decide to discontinue Ctrl Visa Services in response to unforeseen circumstances beyond Ctrl Visa control or to comply with a legal requirement. If we do so, we’ll give you reasonable prior notice so that you can export your documents from our systems.
15. General Provisions
Waiver, Severability & Assignment
If a provision is found unenforceable, the remaining provisions of these Terms and Conditions will remain in full effect and an enforceable term will be substituted reflecting our intent as closely as possible. You may not assign any of your rights under these Terms and Conditions, and any such attempt will be void. Ctrl Visa may assign its rights to any of its affiliates or subsidiaries, or to any successor in interest of any business associated with the Services.
Changes to the Terms and Conditions
Ctrl Visa , in its sole discretion, may change, amend, cancel or withdraw any or all the Terms and Conditions mentioned herein due to
(a) changes in law,
(b) new regulatory requirements,

Ctrl Visa fees include Subscription fee and per transaction fee as specified on Ctrl Visa website. Ctrl Visa fees is subject to change with prior intimation to you. To use Ctrl Visa, it is imperative that user has made all payment of Ctrl Visa Fees in advance as applicable to users as per the payment terms to avail Ctrl Visa Services.
General payment terms: Yearly Subscription fee will be paid by user in advance upon subscribing the Ctrl Visa portal and will be paid yearly in advance on renewal.
Per visa transaction cost / minimum monthly guarantee and any other cost related to subscription will be paid by the user by 1st day of the month to which the charges are related.
Cancellations and Refunds policy of Ctrl Visa
Ctrl Visa fees collected from you for using Ctrl Visa portal are non-refundable.
6. Your Responsibilities
Ctrl Visa is only technology provider. You need to verify all the data collected from your customers through Ctrl Visa portal..
Although Ctrl Visa always maintains the highest security standards when handling your information, we request that you keep your documents and information protected by safeguarding your password. Please, do not share your account credentials or give others access to your account.
You may use Ctrl Visa services only as permitted by applicable law.
7. Use of Ctrl Visa websites/Portal
While accessing or using Ctrl Visa website, the user shall not:
i. Post any content or items in an inappropriate category or areas on the Website nor post any material in whatever form, on the Website for any purpose other than the purpose for which the website is intended;
ii. Violate any laws, third party rights, or policies of Ctrl Visa ;

Ctrl Visa or any of its officers, directors, employees or agents shall have no responsibility and/or liability of any nature, for any reason whatsoever for any delays, or for loss of or damage to any visa application, passport or other documents, caused by, or occurring whilst any application, passport or document is in the possession of, any third party postal or delivery service, including, during the process of transportation of visa applications, passport or other documents between you / your client / employees and the Diplomatic Embassy and when being returned by you to your client / employees.

Ctrl Visa shall be entitled to recover from the user all costs and expenses incurred by Ctrl Visa in obtaining the injunction, including attorney's fees.

Waiver, Severability & Assignment
If a provision is found unenforceable, the remaining provisions of these Terms and Conditions will remain in full effect and an enforceable term will be substituted reflecting our intent as closely as possible.
